Mais avant de remettre vos cl\u00e9s, une mise au point s&rsquo;impose : contrairement \u00e0 une croyance tenace, <strong>il n&rsquo;existe pas au Qu\u00e9bec de droit de \u00ab briser son bail \u00bb moyennant trois mois d&rsquo;avis<\/strong>. Pour partir avant l&rsquo;\u00e9ch\u00e9ance, vous avez essentiellement trois avenues, chacune avec ses propres r\u00e8gles. Voici comment vous y retrouver.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La cession de bail : pour un d\u00e9part d\u00e9finitif<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La cession de bail consiste \u00e0 transf\u00e9rer votre bail \u00e0 une autre personne, qui devient locataire \u00e0 votre place, aux m\u00eames conditions et au m\u00eame loyer. C&rsquo;est l&rsquo;option \u00e0 privil\u00e9gier si vous quittez pour de bon, car une fois la cession accept\u00e9e, vous \u00eates enti\u00e8rement lib\u00e9r\u00e9 de vos obligations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La marche \u00e0 suivre : vous trouvez vous-m\u00eame un candidat, puis vous envoyez \u00e0 votre propri\u00e9taire un <strong>avis \u00e9crit<\/strong> indiquant le nom et l&rsquo;adresse de cette personne ainsi que la date de cession souhait\u00e9e. Le propri\u00e9taire dispose alors de <strong>15 jours pour r\u00e9pondre<\/strong>. Son silence \u00e9quivaut \u00e0 un accord.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attention, c&rsquo;est ici que la <strong>Loi 31 (entr\u00e9e en vigueur le 21 f\u00e9vrier 2024)<\/strong> a tout chang\u00e9. Auparavant, le propri\u00e9taire ne pouvait refuser une cession que pour un motif s\u00e9rieux. D\u00e9sormais, il peut la refuser <strong>sans motif s\u00e9rieux<\/strong>. Mais ce refus a une cons\u00e9quence importante :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Refus sans motif s\u00e9rieux<\/strong> : le bail est automatiquement r\u00e9sili\u00e9 \u00e0 la date de cession pr\u00e9vue dans votre avis. Vous partez sans p\u00e9nalit\u00e9, mais votre candidat ne reprend pas le logement.<\/li>\n\n\n\n<li><strong>Refus avec motif s\u00e9rieux<\/strong> (par exemple, l&rsquo;insolvabilit\u00e9 du candidat) : le bail reste en vigueur et vous demeurez locataire.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Cons\u00e9quence pratique : m\u00eame refus\u00e9e, une cession peut donc vous permettre de quitter votre logement sans frais. Notez aussi que le propri\u00e9taire ne peut vous r\u00e9clamer que le remboursement de frais raisonnables li\u00e9s \u00e0 la cession, et seulement s&rsquo;il y consent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La sous-location : pour une absence temporaire<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La sous-location convient lorsque vous comptez <strong>revenir<\/strong> \u2014 un stage de quelques mois, un voyage prolong\u00e9, une mutation temporaire. Vous gardez votre bail et installez un sous-locataire pendant votre absence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">La proc\u00e9dure ressemble \u00e0 celle de la cession : avis \u00e9crit avec les coordonn\u00e9es du sous-locataire et d\u00e9lai de r\u00e9ponse de 15 jours pour le propri\u00e9taire. Diff\u00e9rence majeure avec la Loi 31 : pour la sous-location, le propri\u00e9taire <strong>ne peut toujours refuser que pour un motif s\u00e9rieux<\/strong>. Les r\u00e8gles n&rsquo;ont pas chang\u00e9.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mais il y a un pi\u00e8ge \u00e0 conna\u00eetre : <strong>vous restez responsable du bail<\/strong>. Si le sous-locataire ne paie pas le loyer ou cause des dommages, c&rsquo;est vous que le propri\u00e9taire peut tenir responsable. C&rsquo;est pourquoi, pour un d\u00e9part d\u00e9finitif, la cession demeure presque toujours le meilleur choix.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La r\u00e9siliation : seulement dans des cas pr\u00e9vus par la loi<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">La r\u00e9siliation permet de mettre fin au bail en cours, mais uniquement dans <strong>quatre situations<\/strong> pr\u00e9cises encadr\u00e9es par le Code civil :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>On vous attribue un <strong>logement \u00e0 loyer modique<\/strong> (HLM).<\/li>\n\n\n\n<li>Un <strong>handicap<\/strong> apparu ou aggrav\u00e9 en cours de bail vous emp\u00eache d&rsquo;occuper le logement.<\/li>\n\n\n\n<li>Vous \u00eates une <strong>personne a\u00een\u00e9e<\/strong> admise de fa\u00e7on permanente en CHSLD, en ressource interm\u00e9diaire ou dans certaines r\u00e9sidences.<\/li>\n\n\n\n<li>Vous ou un enfant qui habite avec vous \u00eates <strong>victime de violence conjugale ou d&rsquo;une agression \u00e0 caract\u00e8re sexuel<\/strong>, et votre s\u00e9curit\u00e9 est menac\u00e9e.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Dans tous les cas, vous devez transmettre un <strong>avis de r\u00e9siliation accompagn\u00e9 d&rsquo;une attestation<\/strong> d&rsquo;un organisme comp\u00e9tent. Le bail prend alors fin <strong>deux mois<\/strong> apr\u00e8s l&rsquo;avis (un mois si le bail est de moins de 12 mois ou \u00e0 dur\u00e9e ind\u00e9termin\u00e9e), et vous continuez de payer le loyer jusque-l\u00e0.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Et l&rsquo;entente \u00e0 l&rsquo;amiable ?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Aucune de ces options ne correspond \u00e0 votre situation? Rien ne vous emp\u00eache de <strong>n\u00e9gocier directement<\/strong> avec votre propri\u00e9taire. Une entente \u00e9crite mettant fin au bail d&rsquo;un commun accord est parfaitement valable \u2014 et souvent la voie la plus simple si les deux parties y trouvent leur compte.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">En cas de d\u00e9saccord ou de doute, le <strong>Tribunal administratif du logement (TAL)<\/strong> offre des mod\u00e8les d&rsquo;avis et de l&rsquo;information gratuite.
