{"id":141,"date":"2016-05-31T20:02:53","date_gmt":"2016-05-31T20:02:53","guid":{"rendered":"https:\/\/www.logisquebec.com\/blog\/?p=141"},"modified":"2017-10-23T17:57:26","modified_gmt":"2017-10-23T17:57:26","slug":"elements-essentiels-contrat-de-location","status":"publish","type":"post","link":"https:\/\/www.logisquebec.com\/blog\/elements-essentiels-contrat-de-location\/","title":{"rendered":"Les \u00e9l\u00e9ments essentiels du contrat de sous-location"},"content":{"rendered":"<p>Une rencontre, un transfert ou un voyage peuvent conduire \u00e0 <a href=\"https:\/\/www.logisquebec.com\/guide-du-locataire\/a-quelles-conditions-pouvez-vous-sous-louer-votre-logement\">sous-louer son logement<\/a>. \u00c0 la diff\u00e9rence de la cession de bail, la sous-location, qui est g\u00e9n\u00e9ralement temporaire, permet de conserver son droit au maintien dans les lieux \u00e0 la fin du contrat de sous-location. Il convient tout de m\u00eame de v\u00e9rifier que l\u2019on se trouve dans une situation autorisant ce type d\u2019accord et comme tout contrat, de contr\u00f4ler qu\u2019il int\u00e8gre les \u00e9l\u00e9ments permettant de prot\u00e9ger ses int\u00e9r\u00eats.<\/p>\n<p>Hormis trois cas de figure, un locataire peut sous-louer son logement sous r\u00e9serve d\u2019obtenir l\u2019accord du propri\u00e9taire. L\u2019usage veut qu\u2019on utilise g\u00e9n\u00e9ralement un bail et que l\u2019on remplace le terme propri\u00e9taire par sous-locateur et locataire par sous-locataire. On am\u00e9nage ensuite le contrat en pr\u00eatant une attention particuli\u00e8re \u00e0 certaines clauses, tout en conservant la possibilit\u00e9 d\u2019en ajouter.<!--more--><\/p>\n<h3>Le contrat de sous-location doit \u00eatre au moins aussi restrictif que le bail de location<\/h3>\n<p>Si, par exemple, le bail interdit la pr\u00e9sence d\u2019animaux dans le logement, le contrat de sous-location doit obligatoirement reprendre cette restriction. Cela ne marche pas dans le sens inverse. Dans le cas o\u00f9 le bail autorise la pr\u00e9sence d\u2019animaux, le sous-locateur a les deux possibilit\u00e9s, soit l\u2019autoriser, soit l\u2019interdire. Cela est valable pour toutes les autres restrictions, et notamment en ce qui concerne l\u2019autorisation de fumer dans le logement.<\/p>\n<h3>Un contrat de sous-location doit int\u00e9grer une clause pr\u00e9voyant un droit de visite<\/h3>\n<p>Le sous-locateur restant garant du bon \u00e9tat du logement vis \u00e0 vis du propri\u00e9taire, il a tout int\u00e9r\u00eat \u00e0 contr\u00f4ler ou faire v\u00e9rifier r\u00e9guli\u00e8rement l\u2019\u00e9tat du logement et de ses \u00e9quipements. Dans le cas o\u00f9 le sous-locateur se trouve \u00e0 l\u2019\u00e9tranger, il est possible de pr\u00e9voir un droit de visite du logement \u00e0 intervalles raisonnables, par exemple chaque semestre, par un de ses proches.<\/p>\n<h3>Une clause concernant les charges li\u00e9es aux abonnements doit \u00eatre pr\u00e9vue<\/h3>\n<p>Bien qu\u2019il soit conseill\u00e9 de r\u00e9silier tous les abonnements avant de quitter les lieux, si certains contrats tels que l\u2019\u00e9lectricit\u00e9 ou internet sont maintenus pendant la dur\u00e9e de la sous-location, il convient de pr\u00e9voir une clause d\u00e9terminant les modalit\u00e9s de paiement de ces charges.<\/p>\n<h3>Le respect du r\u00e8glement de l\u2019immeuble doit \u00eatre stipul\u00e9 dans le contrat<\/h3>\n<p>S\u2019il existe un r\u00e8glement d\u2019immeuble, il est vivement conseill\u00e9 de le mentionner dans le contrat de sous-location, en pr\u00e9cisant que le sous-locataire a obligation de s\u2019y conformer. Une copie du r\u00e8glement doit \u00e9galement lui \u00eatre remise \u00e0 la signature de l\u2019accord.<\/p>\n<h3>La dur\u00e9e du contrat<\/h3>\n<p>Il y deux mani\u00e8res de fixer cette dur\u00e9e, qui ne doit en aucune mani\u00e8re exc\u00e9der celle du bail principal. Le contrat de sous-location peut se terminer \u00e0 date fixe, ou dans le cas d\u2019une dur\u00e9e ind\u00e9termin\u00e9e, il est possible d\u2019indiquer qu\u2019il prendra fin au plus tard \u00e0 la date \u00e0 laquelle prend fin le bail principal.<\/p>\n<h3>Une clause de rappel concernant les manquements<\/h3>\n<p>Int\u00e9grer une clause rappelant que tout manquement du sous-locataire peut entra\u00eener la r\u00e9siliation du contrat par le locateur ou le sous-locateur est vivement conseill\u00e9.<\/p>\n<h3>La liste des r\u00e9parations \u00e0 la charge du sous-locataire<\/h3>\n<p>Les accords \u00e9crits \u00e9tant par d\u00e9finition pr\u00e9f\u00e9rables aux accords verbaux, autant int\u00e9grer une clause stipulant quelles sont les r\u00e9parations qui incombent au sous-locataire.<\/p>\n<h3>Le prix du loyer et la date de paiement<\/h3>\n<p>Au Qu\u00e9bec, le loyer objet de sous-location ne peut pas \u00eatre plus \u00e9lev\u00e9 que celui r\u00e9gl\u00e9 au locateur. En revanche, il peut \u00eatre plus bas, charge au sous-locateur de verser la diff\u00e9rence au propri\u00e9taire. Quelle que soit la somme convenue, il est indispensable d\u2019ins\u00e9rer une clause indiquant le loyer ainsi que la date de paiement.<\/p>\n<p>Comme tout accord \u00e9crit, le contrat de sous-location vise \u00e0 mettre noir sur blanc les termes de l\u2019entente et permet de prot\u00e9ger les droits et rappeler les obligations de chacun.
