Chaque hausse de loyer doit \u00eatre pr\u00e9c\u00e9d\u00e9e de l&rsquo;envoi d&rsquo;un avis \u00e9crit au locataire un \u00e0 six mois avant le terme du bail, le pr\u00e9avis \u00e9tant diff\u00e9rent en fonction de la dur\u00e9e du contrat. Mais comment calcule-t-on une augmentation de loyer puisqu\u2019il n\u2019existe pas de taux fixe ?<\/p>\n<h3>Se baser sur les taux d\u2019ajustement de loyer publi\u00e9s par la R\u00e9gie du logement<\/h3>\n<p>Chaque ann\u00e9e, la R\u00e9gie du logement publie des taux d\u2019ajustement recommand\u00e9s. En 2016, par exemple, elle pr\u00e9conisait une augmentation de loyer de 0,4 % pour les logements non chauff\u00e9s et 0,7 % pour les loyers incluant le chauffage. Pourtant, selon l\u2019avis de la CORPIQ, la Corporation des Propri\u00e9taires <a href=\"https:\/\/www.logisquebec.com\/a-louer\">Immobiliers du Qu\u00e9bec<\/a>, cette hausse est bien loin de couvrir l\u2019augmentation des taxes assum\u00e9es par le propri\u00e9taire et la forte hausse des primes d\u2019assurance des logements situ\u00e9s dans des condos. Comme ces taux correspondent \u00e0 une moyenne et ne tiennent pas compte des sp\u00e9cificit\u00e9s de chaque logement, il convient de reprendre chaque charge afin d\u2019int\u00e9grer l\u2019augmentation du poste de d\u00e9pense correspondant, et notamment la hausse de taxe municipale, de taxe scolaire ou encore d\u2019assurance.<!--more--><\/p>\n<p>S\u2019agissant des d\u00e9penses \u00e9nerg\u00e9tiques et d\u2019autres frais, regroup\u00e9es sous l\u2019appellation d\u00e9penses d\u2019exploitation, la R\u00e9gie publie \u00e9galement un taux d\u2019ajustement par poste :<\/p>\n<ul>\n<li>l\u2019\u00e9lectricit\u00e9 (+ 2,4 % en 2016)<\/li>\n<li>le gaz (- 3,2 % en 2016)<\/li>\n<li>le mazout (+ 24,3 % en 2016)<\/li>\n<li>l\u2019entretien (+ 2,5 % en 2016)<\/li>\n<li>les services (+ 1,9 % en 2016)<\/li>\n<li>les frais de gestion (+ 1,0 % en 2016)<\/li>\n<\/ul>\n<p>L\u2019ensemble de ces taux est librement accessible en ligne sur le site de la R\u00e9gie du logement qui propose m\u00eame un <a href=\"https:\/\/www.rdl.gouv.qc.ca\/fr\/calcul-pour-la-fixation-de-loyer\/outil-de-calcul\">formulaire en ligne de calcul d\u2019augmentation de loyer<\/a>.<\/p>\n<h3>Int\u00e9grer les r\u00e9parations ou am\u00e9liorations majeures<\/h3>\n<p>Selon le R\u00e8glement sur les crit\u00e8res de fixation du co\u00fbt du loyer, il est possible d\u2019augmenter un loyer de mani\u00e8re plus importante dans le cas de la r\u00e9alisation de travaux visant \u00e0 modifier ou r\u00e9parer les principaux \u00e9l\u00e9ments de la structure de l\u2019immeuble tels que la toiture, le syst\u00e8me de chauffage, l\u2019isolation, les fen\u00eatres, la tuyauterie, ou de travaux de r\u00e9novation (am\u00e9nagements divers) dans le logement ou les parties communes, ou encore de nouvelles installations (piscine, places de stationnement, etc.).<\/p>\n<p>Ainsi la R\u00e9gie du logement \u00e9tablit-elle \u00e9galement un pourcentage applicable \u00e0 ce type de d\u00e9penses dites d\u2019immobilisation. En 2016, ce taux \u00e9tait de 2,5 %, mais l\u00e0 encore, il convient de tenir compte de la sp\u00e9cificit\u00e9 des travaux effectu\u00e9s dans l\u2019immeuble et de la part imputable au logement lou\u00e9.<\/p>\n<p>Par mesure de prudence, il est pr\u00e9f\u00e9rable d\u2019utiliser un calculateur comme celui mis \u00e0 disposition par la R\u00e9gie du logement, car il tient compte de chaque poste de d\u00e9pense, allant des taxes municipale et scolaire aux co\u00fbts de l\u2019exploitation de l\u2019immeuble en passant par l\u2019assurance et les am\u00e9liorations majeures. Le calcul effectu\u00e9 permet de d\u00e9terminer de mani\u00e8re pr\u00e9cise une augmentation de loyer juste et raisonnable, offrant une base de discussion aux locateurs et locataires et \u00e9vitant dans la majorit\u00e9 des cas de s\u2019exposer aux risques d\u2019une contestation du locataire et d\u2019une fixation du montant du loyer par la R\u00e9gie du logement.<\/p>\n<p>M\u00eame si la hausse de loyer est conforme \u00e0 la loi, rien n\u2019emp\u00eache le locataire de la contester dans le mois qui suit la r\u00e9ception de l\u2019avis si le logement n\u2019est pas situ\u00e9 dans un immeuble de moins de 5 ans ou transform\u00e9 \u00e0 des fins locatives au cours des 5 derni\u00e8res ann\u00e9es.
