Celles-ci concernent essentiellement l&rsquo;entretien du terrain et des parties communes de l&rsquo;immeuble et pour 5 % au minimum le Fonds de pr\u00e9voyance.<\/p>\n<h3>1. Les frais de condo ne se r\u00e9partissent pas uniquement sur la surface habitable<\/h3>\n<p>M\u00eame s&rsquo;ils entrent dans le calcul des clefs de r\u00e9partition des charges, le nombre de logements ou la surface habitable ne sont pas les crit\u00e8res qui servent de base pour r\u00e9partir les frais de condo. En effet, conform\u00e9ment \u00e0 la loi, les charges communes sont r\u00e9parties en fonction de la valeur relative de la fraction d&rsquo;un copropri\u00e9taire, qui est le seul mode de r\u00e9partition possible. La valeur relative d&rsquo;une fraction d\u00e9termin\u00e9e est exprim\u00e9e dans la d\u00e9claration de copropri\u00e9t\u00e9 sous forme de pourcentage ou de fraction et correspond \u00e0 la valeur d&rsquo;un lot par rapport \u00e0 l&rsquo;ensemble de l&rsquo;immeuble. Elle est calcul\u00e9e sur la base de ses dimensions, mais \u00e9galement de sa nature, de sa destination et de sa situation.<!--more--><\/p>\n<h3>2. Le fonds de pr\u00e9voyance<\/h3>\n<p>Il s&rsquo;agit d&rsquo;une r\u00e9serve d&rsquo;argent qui r\u00e9pond \u00e0 une exigence l\u00e9gale. Au Qu\u00e9bec, elle repr\u00e9sente au moins 5 % des frais de condo et est destin\u00e9e \u00e0 couvrir d&rsquo;\u00e9ventuels travaux majeurs sur l&rsquo;immeuble. Le fonds de pr\u00e9voyance est constitu\u00e9 par le syndicat de copropri\u00e9t\u00e9, qui en est \u00e9galement propri\u00e9taire, ce qui signifie qu&rsquo;un copropri\u00e9taire qui vend son condo ne peut pr\u00e9tendre \u00e0 r\u00e9cup\u00e9rer les sommes qu&rsquo;il y a vers\u00e9es et qui n&rsquo;auraient pas \u00e9t\u00e9 d\u00e9pens\u00e9es. Dans la r\u00e9alit\u00e9, le taux de 5 % est insuffisant, les copropri\u00e9taires devant payer un compl\u00e9ment substantiel lorsqu&rsquo;il est temps d&rsquo;effectuer des r\u00e9parations.<\/p>\n<h3>3. Les frais de condo peu \u00e9lev\u00e9s cachent de mauvaises surprises<\/h3>\n<p>Quand les copropri\u00e9t\u00e9s affichent des frais de condo \u00e9tonnamment bas, la m\u00e9fiance est de rigueur. C&rsquo;est le cas de trop nombreux condos et notamment ceux pr\u00e9sent\u00e9s par les promoteurs qui minimisent les frais de condo afin de vendre plus facilement les lots. Or, les frais all\u00e9g\u00e9s cachent tr\u00e8s souvent une d\u00e9ficience du fonds de pr\u00e9voyance, un manque d&rsquo;entretien pr\u00e9ventif et l&rsquo;inex\u00e9cution de travaux de travaux n\u00e9cessaires. Autrement dit, seules les factures des fluides, de nettoyage et d&rsquo;assurance sont r\u00e9gl\u00e9es. Une telle n\u00e9gligence augmente le nombre de sinistres, et notamment les d\u00e9g\u00e2ts des eaux par infiltration par le toit ou les murs ext\u00e9rieurs, ce qui a pour cons\u00e9quence de faire grimper les primes d&rsquo;assurance.<\/p>\n<h3>4. Les d\u00e9passements de frais de condo<\/h3>\n<p>Lorsque le budget pr\u00e9visionnel des frais de condo n&rsquo;est pas suffisant pour faire face aux d\u00e9penses, le syndicat appelle des cotisations sp\u00e9ciales aupr\u00e8s des copropri\u00e9taires. Il s&rsquo;agit de sommes d&rsquo;argent n\u00e9cessaires pour compl\u00e9ter le budget et faire face \u00e0 l&rsquo;ensemble des d\u00e9penses. De telles situations s&rsquo;expliquent soit par le fait que le budget a \u00e9t\u00e9 minimis\u00e9, ce qui est souvent le cas des immeubles neufs, soit que l&rsquo;immeuble est mal g\u00e9r\u00e9, soit qu&rsquo;il a fallu r\u00e9gler une d\u00e9pense impr\u00e9vue.<\/p>\n<h3>5. Les frais de condo compar\u00e9s aux charges d&rsquo;une maison<\/h3>\n<p>Les frais de condo semblent souvent \u00e9lev\u00e9s aux yeux de propri\u00e9taires de maison, car ils ont tendance \u00e0 ne pas mettre en balance des d\u00e9penses comparables. En effet, les charges de l&rsquo;immeuble comprennent une partie des fluides consomm\u00e9s par les habitants, mais incluent \u00e9galement des services dont ne b\u00e9n\u00e9ficient pas toujours les propri\u00e9taires de maisons, comme le m\u00e9nage des parties communes, ou encore les frais li\u00e9s \u00e0 ascenseur ou la salle de gym.<\/p>\n<p>Les frais de condo que paie chaque propri\u00e9taire correspondent \u00e0 la quote-part de charges de l&rsquo;immeuble qui lui incombe.
