Celles-ci permettent au propri\u00e9taire de demander une augmentation raisonnable du loyer en envoyant un avis au locataire dans un d\u00e9lai raisonnable. Le locataire peut ensuite choisir d\u2019accepter ou de refuser la proposition <strong>dans le mois qui suit l\u2019avis<\/strong> d\u2019augmentation du loyer.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comment se calcule l\u2019augmentation du loyer en 2021?&nbsp;<\/h2>\n\n\n\n<p>Le 20 janvier 2021, le tribunal administratif du logement a \u00e9tabli les nouveaux pourcentages applicables pour l\u2019augmentation du loyer. En 2021, la R\u00e9gie du logement recommande une augmentation de base de 0,8% en moyenne pour un logement non chauff\u00e9 et une augmentation de 0,5% en moyenne pour un logement chauff\u00e9 \u00e0 l\u2019\u00e9lectricit\u00e9.&nbsp;<\/p>\n\n\n\n<p>Pour les logements chauff\u00e9s au gaz et au mazout, la R\u00e9gie pr\u00e9conise respectivement une diminution du loyer de 0,3% et de 3 % en moyenne. \u00c0 cela, s\u2019ajoutent d\u2019autres pourcentages applicables qui d\u00e9pendent de diff\u00e9rentes composantes du loyer:&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u00c9lectricit\u00e9: -0,3%&nbsp;<\/li><li>Gaz: -11,3%<\/li><li>Mazout et autres sources d\u2019\u00e9nergie:&nbsp; 1,4%&nbsp;<\/li><li>Frais d\u2019entretien: 1,4%&nbsp;<\/li><li>Frais de service: 1,9%<\/li><li>Frais de gestion: 1,2%<\/li><li>Revenu net: 0,6%<\/li><li>D\u00e9penses d\u2019immobilisation: 2,3%&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>Il est cependant important de mentionner que ces pourcentages applicables ne sont pas des augmentations moyennes de loyer recommand\u00e9es par la R\u00e9gie. <\/strong>Il faut \u00e9galement tenir compte d\u2019autres crit\u00e8res de fixation du loyer tels que:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La pr\u00e9sence ou non de travaux majeurs;&nbsp;&nbsp;&nbsp;<\/li><li>La variation des primes d\u2019assurances;&nbsp;&nbsp;<\/li><li>Les hausses de taxes municipales et\/ou scolaires.&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p>Pour vous aider \u00e0 vous y retrouver, il existe un <a href=\"https:\/\/www.tal.gouv.qc.ca\/fr\/calcul-pour-la-fixation-de-loyer\/outil-de-calcul\" target=\"_blank\" rel=\"noreferrer noopener\">outil de calcul pour la fixation du loyer<\/a>. Il vous permettra de mieux savoir \u00e0 quoi devrait correspondre l&rsquo;augmentation du loyer en 2021 pour \u00eatre juste et \u00e9quitable. Pour faire une demande de modification au bail qui inclut une hausse du loyer, le propri\u00e9taire doit envoyer un avis dans un d\u00e9lai qui d\u00e9pend du type de bail. Pour un bail de 12 mois, l\u2019avis doit \u00eatre envoy\u00e9 3 \u00e0 6 mois avant la fin du bail.&nbsp;<\/p>\n\n\n\n<p>Pour \u00eatre l\u00e9gal, l\u2019avis d\u2019augmentation du loyer doit inclure plusieurs informations telles que:&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Le nouveau montant du loyer ou le pourcentage d&rsquo;augmentation par rapport au loyer pr\u00e9c\u00e9dent;&nbsp;<\/li><li>Le d\u00e9lai accord\u00e9 pour refuser l\u2019augmentation propos\u00e9e;&nbsp;&nbsp;<\/li><li>Les autres demandes de modifications, si n\u00e9cessaire.&nbsp;<\/li><\/ul>\n\n\n\n<p>La R\u00e9gie recommande g\u00e9n\u00e9ralement une augmentation moyenne du loyer de 1 \u00e0 2% par ann\u00e9e. Cependant, il est rare que les propri\u00e9taires tiennent compte des recommandations de la R\u00e9gie pour fixer le montant de l&rsquo;augmentation du loyer.&nbsp;<\/p>\n\n\n\n<p>Ces derniers se fient principalement sur le prix des loyers dans les logements similaires du quartier en tenant compte de plusieurs facteurs, comme la proximit\u00e9 des services publics ou d\u2019une station de m\u00e9tro, par exemple.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Comment contester une hausse de loyer?&nbsp;&nbsp;<\/h2>\n\n\n\n<p>Pour contester une hausse de loyer, le locataire doit envoyer un avis au propri\u00e9taire dans le mois qui a suivi la demande de modification. Le propri\u00e9taire et le locataire peuvent alors n\u00e9gocier une entente \u00e0 l\u2019amiable.&nbsp;<\/p>\n\n\n\n<p>S\u2019il n\u2019y a toujours pas d\u2019entente apr\u00e8s plusieurs mois, le propri\u00e9taire peut s\u2019adresser au tribunal administratif du logement pour faire sa demande de modification.
