Elle d\u00e9finit les r\u00e8gles relatives \u00e0 la vie commune et \u00e0 l&rsquo;administration de la copropri\u00e9t\u00e9. Tous les copropri\u00e9taires ainsi que les membres du conseil d&rsquo;administration doivent en prendre connaissance. Cela est indispensable au bon fonctionnement de la copropri\u00e9t\u00e9.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Quelles sont les trois parties composant la d\u00e9claration de copropri\u00e9t\u00e9?&nbsp;&nbsp;<\/h2>\n\n\n\n<p>La d\u00e9claration de copropri\u00e9t\u00e9 est divis\u00e9e en 3 parties: l&rsquo;acte constitutif de la propri\u00e9t\u00e9, le r\u00e8glement de l&rsquo;immeuble et l&rsquo;\u00e9tat descriptif des fractions.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Premi\u00e8re partie : acte constitutif de copropri\u00e9t\u00e9&nbsp;<\/h3>\n\n\n\n<p>L&rsquo;acte constitutif de copropri\u00e9t\u00e9 est compos\u00e9 de plusieurs \u00e9l\u00e9ments :&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La <strong>destination de l&rsquo;immeuble<\/strong>, c&rsquo;est-\u00e0-dire la vocation de celui-ci. Elle peut \u00eatre exclusivement r\u00e9sidentielle ou commerciale. Elle peut \u00e9galement \u00eatre mixte avec, par exemple, des commerces au rez-de-chauss\u00e9e et des appartements \u00e0 l&rsquo;\u00e9tage.&nbsp;&nbsp;<\/li><li>Les <strong>parties privatives<\/strong> (unit\u00e9s d&rsquo;habitations) et les <strong>parties communes<\/strong> (qui font partie du b\u00e2timent principal.&nbsp;&nbsp;<\/li><li>La <strong>valeur relative des fractions<\/strong>, le <strong>nombre de voix<\/strong> \u00e0 l&rsquo;assembl\u00e9e des copropri\u00e9taires rattach\u00e9e \u00e0 chaque fraction et la <strong>quote-part des charges communes<\/strong>.&nbsp;<\/li><li>La <strong>r\u00e9partition des pouvoirs<\/strong> entre l&rsquo;assembl\u00e9e des copropri\u00e9taires et les membres du conseil d&rsquo;administration.&nbsp;&nbsp;&nbsp;<\/li><\/ul>\n\n\n\n<p>Depuis le 10 janvier 2020, les modifications ou les ajouts d&rsquo;une clause p\u00e9nale doivent \u00eatre approuv\u00e9s par l&rsquo;assembl\u00e9e des copropri\u00e9taires. Un acte notari\u00e9 devra ensuite l&rsquo;int\u00e9grer \u00e0 la d\u00e9claration de copropri\u00e9t\u00e9. Elle sera ensuite publi\u00e9e au Registre foncier. Les clauses p\u00e9nales qui ont \u00e9t\u00e9 ajout\u00e9es avant le 10 janvier 2020 sont incluses dans l&rsquo;acte constitutif de copropri\u00e9t\u00e9.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Deuxi\u00e8me partie : le r\u00e8glement de l&rsquo;immeuble&nbsp;<\/h3>\n\n\n\n<p>Le r\u00e8glement de l&rsquo;immeuble inclut toutes les obligations et les r\u00e8gles de vie commune que doivent respecter les occupants de l&rsquo;immeuble ainsi que les copropri\u00e9taires. Elles concernent les parties privatives et les parties communes. M\u00eame le copropri\u00e9taire d&rsquo;un b\u00e2timent ne peut donc pas faire tout ce qu&rsquo;il veut.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Les locataires ont \u00e9galement l&rsquo;obligation de respecter les r\u00e8gles de vie commune. Le propri\u00e9taire qui loue son appartement doit remettre une copie du r\u00e8glement de l&rsquo;immeuble au locataire. Le<a href=\"https:\/\/www.logisquebec.com\/blog\/le-role-et-fonctionnement-dun-syndicat-de-copropriete-au-quebec\/\"> syndicat de copropri\u00e9t\u00e9<\/a> doit \u00eatre averti de la date o\u00f9 le locataire a pris connaissance de la d\u00e9claration de copropri\u00e9t\u00e9.&nbsp;&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>Le r\u00e8glement de l&rsquo;immeuble est comporte 3 \u00e9l\u00e9ments :&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Les r\u00e8gles relatives \u00e0 l&rsquo;administration et le fonctionnement de la copropri\u00e9t\u00e9<\/strong> : Elles concernent, entre autres, la composition du conseil d&rsquo;administration et les modalit\u00e9s sur la tenue des assembl\u00e9es et des r\u00e9unions.&nbsp;<\/li><li><strong>Les r\u00e8gles qui concernent l&rsquo;usage et l&rsquo;entretien des parties communes et des parties privatives<\/strong> :&nbsp; Elles concernent les droits de jouissance de chaque copropri\u00e9taire au sein des parties privatives et communes. Elles portent le plus souvent sur le droit de jouissance exclusif des parties communes \u00e0 usage restreint.
