Quant aux logements chauff\u00e9s au gaz et au mazout, l\u2019augmentation moyenne pr\u00e9conis\u00e9e par la R\u00e9gie est de 1,91 % pour le gaz et de 3,73 % pour le mazout.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Les autres pourcentages applicables \u00e0 l\u2019augmentation de loyer au Qu\u00e9bec<\/h3>\n\n\n\n<p>Outre l\u2019augmentation de base recommand\u00e9e par la r\u00e9gie, il existe <strong>d\u2019autres pourcentages applicables <\/strong>qui d\u00e9pendent de diff\u00e9rents composants du loyer :&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u00c9lectricit\u00e9 : 0,9 %&nbsp;<\/li><li>Gaz : 7,6 %<\/li><li>Mazout et autres sources d\u2019\u00e9nergie : 17,5 %&nbsp;<\/li><li>Frais d\u2019entretien : 1,6 %&nbsp;<\/li><li>Frais de service : 3,1 %<\/li><li>Frais de gestion : 2,7 %<\/li><li>Revenu net : 1,4 %<\/li><li>D\u00e9penses d\u2019immobilisation : 2,0 %&nbsp;<\/li><\/ul>\n\n\n\n<p><strong>Cependant, il est important de noter que ces pourcentages applicables ne sont pas recommand\u00e9s par la R\u00e9gie. <\/strong>Il existe de nombreux autres crit\u00e8res de fixation du loyer qui influencent l\u2019augmentation de loyer, tels que :<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>La r\u00e9alisation de travaux majeurs ou non\u2009;&nbsp;&nbsp;&nbsp;<\/li><li>L\u2019augmentation ou la variation des primes d\u2019assurances\u2009;&nbsp;&nbsp;<\/li><li>Une hausse des taxes municipales et scolaires ;<\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">L\u2019outil de calcul d\u2019augmentation de loyer du tribunal administratif du Logement<\/h3>\n\n\n\n<p>Il existe <a href=\"https:\/\/www.tal.gouv.qc.ca\/fr\/calcul-pour-la-fixation-de-loyer\/outil-de-calcul\" target=\"_blank\" rel=\"noreferrer noopener\">un outil de calcul pour la fixation du loyer<\/a> mis \u00e0 la disposition des propri\u00e9taires par la R\u00e9gie. Cet outil vous permet de faire <strong>un calcul juste et \u00e9quitable<\/strong> pour une augmentation de loyer en 2022 au Qu\u00e9bec.\u00a0<\/p>\n\n\n\n<p>L\u2019avantage principal d\u2019utiliser l\u2019outil de calcul est qu\u2019il inclut \u00e9galement plusieurs facteurs qui peuvent influencer la hausse du loyer. Pour un bail de 12 mois, cet avis doit \u00eatre envoy\u00e9 <strong>entre 3 \u00e0 6 mois avant la fin du bail.&nbsp;<\/strong><\/p>\n\n\n\n<p>Pour une question de l\u00e9galit\u00e9, les informations suivantes doivent se trouver dans l\u2019avis d\u2019augmentation de loyer :&nbsp;&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Le nouveaux prix demand\u00e9 pour le loyer ainsi que le pourcentage d\u2019augmentation par rapport au loyer propos\u00e9 pr\u00e9c\u00e9dent\u2009;&nbsp;<\/li><li>Le d\u00e9lai accord\u00e9 pour refuser l\u2019augmentation propos\u00e9e\u2009;&nbsp;&nbsp;<\/li><li>Toutes autres demandes de modifications, si n\u00e9cessaire.&nbsp;<\/li><\/ul>\n\n\n\n<p>En r\u00e8gle g\u00e9n\u00e9rale, <strong>une augmentation moyenne du loyer de 1 \u00e0 2 % par ann\u00e9e <\/strong>est recommand\u00e9e par le TAL<strong>.<\/strong> Il est cependant rare que les propri\u00e9taires consid\u00e8rent les recommandations de la R\u00e9gie pour fixer le montant de l\u2019augmentation de loyer.&nbsp;<\/p>\n\n\n\n<p>Ces derniers tiennent principalement compte <strong>du prix des loyers des logements comparables dans leur quartier.<\/strong> Les propri\u00e9taires consid\u00e8rent donc plusieurs facteurs comme la proximit\u00e9 des services publics ou d\u2019une station de m\u00e9tro, par exemple.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Locataires : comment refuser une hausse de loyer\u2009?&nbsp;&nbsp;<\/h2>\n\n\n\n<p>Afin de contester une hausse de loyer, le locataire doit <strong>envoyer un avis au propri\u00e9taire dans les 30 jours qui a suivi la demande de modification du bail.<\/strong> Le propri\u00e9taire et le locataire peuvent alors n\u00e9gocier une entente \u00e0 l\u2019amiable<a href=\"https:\/\/www.logisquebec.com\/blog\/comment-signer-un-bail-a-distance\/\"> avant la signature du nouveau bail<\/a>.<\/p>\n\n\n\n<p>Le propri\u00e9taire a la possibilit\u00e9 de <strong>s\u2019adresser directement au tribunal administratif du logement<\/strong> pour faire sa demande de modification.
